Do you have to answer questions during a traffic stop?

When a police officer pulls you over, you know that they are probably going to ask you some questions. You may sit in the car, getting your paperwork together, waiting for them to come up to your window. Common documents that you will be asked for include your registration, your driver’s license and your proof of insurance – all things you need to legally operate a motor vehicle. 

But say that the officer approaches your window and asks if you know why they pulled you over. Or perhaps they ask if you have had anything to drink today. Do you have to answer these questions?

You have the right to remain silent

In most encounters with the police, you can exercise your right to remain silent. If the officer asks if you have been drinking, you do not have to comment on either direction. You certainly do not have to admit it and potentially incriminate yourself, which could lead to impaired driving charges.

It is still important to provide the documentation noted above: your driver’s license, your registration, and your insurance paperwork. So you should not just ignore the officer or refuse to communicate with them at all. Doing so will only escalate the situation unnecessarily and increase the odds of an arrest. But at the same time, do not assume that you have to answer all of the officer’s questions just because they pulled you over.
