If the police arrest you and charge you with drunk driving, you might wonder if that is that or if there is any way you can defeat the charges. There are many different arguments that people have successfully used to overturn DUIs, so it pays to consider them all.

Here are some of the more common ones:

The test results were incorrect

You can ask for records showing when the police last took the machine for calibration. Even a small error could mean the difference between walking free and a conviction.

The results could also be wrong if the police officer did not administer the test correctly, so you can check what training they had.

Sometimes a Breathalyzer result can be pushed high by things such as prescription medicine or solvents in your car or on your body.

If it is field sobriety tests they are using to charge you, there are even more ways to challenge those.

If it is a blood test done in the lab, there is a possibility your sample result may have been confused with someone else’s.

The police did not follow proper protocol

You only have to watch the news to see that the police make mistakes all the time and that a few officers ignore protocols on a range of matters. If the police stop and arrest were not carried out as the law demands, a court might decide that the law does not, therefore, permit them to convict you.
